1. Scope and provider

These General Terms and Conditions (GTC) govern the business relationship between the customer ( referred to as "Customer") and TORTON GmbH ( referred to as "Provider") for the provision of chauffeur and limousine services.

These GTC apply to all bookings and services, regardless of whether they are made online, by telephone, by email, or through third parties.

Any differing terms and conditions of the Customer will only be recognized if they have been expressly confirmed in writing by the Provider.

2. Contract conclusion and booking

A contract is concluded upon confirmation of a booking by TORTON GmbH. Bookings can be made by telephone, email, WhatsAPP, website, or through a booking platform.

Confirmation is given verbally or in writing and contains the essential booking details (pick-up location, destination, price, date, and time).

The provider reserves the right to refuse bookings without giving reasons, particularly in the event of capacity constraints or insufficient information.

3. Description of services

TORTON GmbH offers high-quality chauffeur and limousine services, including: airport transfers, business trips and corporate services, city and long-distance transfers, event and VIP transfers, hourly chauffeur bookings, and special trips by individual arrangement.

All trips are carried out with well-maintained, high-quality vehicles and professional chauffeurs.

The provider undertakes to carry out the trip punctually and safely. Delays due to traffic disruptions or force majeure do not entitle the customer to compensation.

4. Prices, payment terms and surcharges

The prices for the services are based on the current price list or individual agreements.

Payment methods: Cash payment to the driver; credit card payment (Visa, Mastercard, Amex); invoicing for business customers by prior arrangement.

Additional charges: Waiting time: Additional charges will be applied after exceeding the free waiting time (see section 6). Night and holiday surcharge: A surcharge may apply for journeys between 10:00 p.m. and 6:00 a.m. and on public holidays. Additional stops: If the customer makes additional stops during the journey, a flat fee or a per-kilometer rate will be charged.

5. Cancellation, rebooking and no-show

Cancellation Policy: Up to 24 hours before departure: free of charge. Less than 12 hours before departure: 50% of the agreed fare. Less than 2 hours before departure or no-show: 100% of the fare.

Rebookings are subject to availability and must be requested at least 3 hours before departure.

The provider reserves the right to cancel a trip if the customer has provided incorrect or incomplete information or for regulatory reasons.

6. Waiting times and delays

Free waiting time: Standard bookings: 15 minutes; Airport transfers: 60 minutes after actual landing (based on live flight data).

After the free waiting time has expired, a fee will be charged for each additional 15 minutes or part thereof.

If the customer fails to appear without prior notification, this will be considered a "no-show" and the full fare will be charged.

7. Customer's obligations

The customer agrees to: Commence the booked journey on time; Appear well-groomed and in a condition that does not impair the journey; Not exhibit any unauthorized behavior during the journey (e.g., smoking, alcohol abuse, soiling of the vehicle).

Damage to or excessive soiling of the vehicle caused by the customer will be charged in full.

8. Liability and Insurance

Liability of the Provider: The provider is liable for damages only in cases of intent or gross negligence. Delays due to force majeure (e.g., traffic jams, weather, strikes) are excluded from liability.

Liability of the Customer: The customer is liable for damages to the vehicle or third parties caused by their actions. Liability exists in particular for damages caused by soiling or willful destruction.

All vehicles are insured in accordance with legal requirements. Any further liability is excluded.

9. Data protection

The provider collects, stores, and processes the customer's personal data solely for processing the booking and providing the services.

Customer data will not be disclosed to third parties unless this is necessary for the performance of the service or required by law.

Further information on data processing is governed by the provider's privacy policy.

10. Jurisdiction and applicable law

Swiss law shall apply exclusively.

The place of jurisdiction for all disputes is Zug, unless mandatory legal provisions stipulate otherwise.

11. Final Provisions

Amendments or additions to these Terms and Conditions must be in writing.

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
